Now – May 9: Complete Your Inventory and Compliance Audit
The first and most urgent step is knowing exactly what you have and where it stands.
Inventory audit: Pull a complete SKU-level inventory count across all warehouse and distributor locations. For each SKU, document current stock quantity, turnover rate, expected shelf-life, and distribution channels.
Compliance audit: For each SKU, pull the current COA and calculate total THC (delta-9 THC + THCA × 0.877). Flag every product that exceeds 0.4mg total THC per container. This is your non-compliant inventory list.

July 1 – July 31: First Commercial Production Runs with Compliant Ingredients
With pilot testing complete and labels approved, July is when compliant product enters the production pipeline.
Commercial production: Schedule and execute first commercial runs of reformulated products using compliant ingredients. Ensure lot-matched COAs are ordered from your lab for each production batch.
Inventory build: Begin building compliant inventory that will be available for distribution in September and October — your primary sales months for compliant product before the deadline.
Distributor notification: Begin formal communication to distributors about the product reformulation. Provide the updated COAs, new label artwork, and a communication plan for retail accounts.
Action: First compliant commercial production completed by July 31.
August 1 – August 31: Accelerate Non-Compliant Inventory Sell-Through
August is the last full month with significant runway for non-compliant inventory sell-through. After August, the window narrows quickly.
Sell-through promotion: Implement any discounting or promotional activity needed to accelerate sell-through of non-compliant inventory. This may include retailer price promotions, bulk purchase incentives, or direct-to-consumer clearance.

Retailer compliance documentation: Provide all retail accounts with updated compliance documentation packages — current COAs, label certifications, and any state-specific compliance materials required for their market.
Final inventory reconciliation: By October 15, non-compliant inventory should be fully managed (sold, returned, donated, or scheduled for destruction). Nothing non-compliant should remain in active distribution.
October 15 – November 12: Final Compliance Verification
Final compliance audit: Conduct a final review of all products in distribution to confirm every SKU in the market has a current, lot-matched COA showing total THC below 0.4mg per container.
State-level compliance check: Verify that each product meets the applicable standard in each state where it’s distributed (some states have stricter standards than the federal baseline).
